課程概述 |
女性主義法律史是用女性主義法學理論來偵訊歷史的法律史。在歷史書寫中女性主義法律史是用女性主義法學理論來偵訊歷史的法律史。在歷史書寫中納入原本被法律史典範排除在外的女性,卻未根本地挑戰法律與社會的形構關係與不平等的權力結構,那是去政治化填補空白的女性法律史。將歷史呈現為法律不斷反映社會變遷而逐漸實現性別平等的旅程,則往往是一種以形式平等為平等來描繪女性法律地位變遷的演化功能主義法律史,既去政治化法律與社會的關係,也單一化平等的樣貌。本課程所探究的女性主義法律史,不是填空式的女性法律史(雖然與其有關),也不是線性進展的演化功能主義法律史,而是剖析法律史知識與性別權力關係的法律史,其目的在於挑戰「法律上的性別歧視隨著社會變遷而逐漸消失,邁向性別平等」的線性法律史,不只重新認識過去,也重新安置過去與現在的關係以開啟對未來的新想像;所追求的不是中性去政治化的歷史描述,而是在女性主義法學理論的探照燈下開展政治性的歷史解釋。
在本學期的課程中,我們將閱讀四種類型的美國法律史作品,以多方開展女性主義法律史的想像。一是「重新看見(被忽略)的女性法律人」(例如:曾被列入考慮但未被提名的女性大法官候選人、有先驅性貢獻但被白女人成就「遮蓋」的黑人女性主義法學者)的法律史,我們將藉此思考「填空」的女性法律史與女性主義法律史的關係與差異。二是性別案件的法律故事,這種法律故事有別於一般以法院為中心的訴訟故事寫作,不只討論「法院之內」所發生的事,更將「法院之外」的發展作為故事的重點,從而凸顯「非法官」的各種行動主體角色,以及法律與社會之間的動態互動。三是從女性主義觀點重寫判決的「女性主義判決」(feminist judgments),此種判決寫作既可以作為性別與裁斷的女性主義「實驗」(女性/女性主義者所做的裁斷是否可以不同),也可以作為女性主義法律史的文類,我們將藉此思考重寫判決的助益與限制:「新的過去」是否有助於開展「新的未來」。四是女性主義法律史的法庭之友意見書(amicus curiae),我們將透過閱讀大規模連署的法庭之友意見書、專門領域學者的法庭之友意見書等不同形態的意見書,探索女性主義法律史與法律倡議的關係,以及女性主義法學與歷史學的合作難題。

課程要求 |
(一)學期成績的評分指標為:上課表現(含課堂報告與評論)(20%)、批判性閱讀心得(40%)、學期報告(40%)。
(二)除有不可抗力之重大例外事由之外,本課程不接受停修之申請。
(三)本課程有以下要求:
1. 每週課程皆應準時出席,生病、檢疫隔離或其他不可抗力事由除外。遲到與缺席列為學期平時成績扣分事項。缺席者,應補交所缺席週次之批判性閱讀心得,該次不計入心得繳交不計入學期應繳交心得之總數。但因生病、檢疫隔離或其他不可抗力事由請假且經教師同意者,所補繳之心得可計入總數。遲到者,須完成教師依遲到程度情況所指定之任務或作業。
2. 完成課程所指定的作業。
3. 課程前預先完成課堂前的閱讀準備,並於每週一中午十二點前繳交該週文獻之批判性閱讀心得報告,於本學期中至少繳交六次(範圍需包含四種類型作品),未足六次者依據缺交次數累計扣分。遲交(晚於週一中午十二點、早於週一晚上十二點)者應完成教師依據遲交程度情況所指定之任務或作業,超過遲交期限者,不予計入。批判性閱讀心得報告的長度為二到三頁,內容應包括三部分:(1)該週文獻之重點為何?作者所使用的方法與資料是否適當?論點是否具有說服力?(2)對於你思考台灣法有何啟發?(3)該週文獻引導你思考哪些問題?
4. 課程中積極參與討論,每週均須於課堂上口頭提出對該週文獻之思考,不論該週是否繳交批判性閱讀心得。上課時不得使用任何電子設備(例如手機、ipad、筆電)從事與課堂無關之活動,違規者需完成教師視違規程度情況所指定之任務或作業。
5. 就本課程選讀四種類型的作品中,選擇一種類型寫作學期報告,並於課堂發表初步研究成果。修課同學應:
(1) 於4月13日提出預定研究的主題(題目與簡要說明),取得教師同意
(2) 於5月18日繳交報告大綱(包含研究主題、初步的研究文獻回顧、研究資料說明、預期的可能研究發現或貢獻,研究文獻回顧必須包含非課程指定閱讀之英文法學文獻)
(3) 於6月1-15日三週間進行課堂報告(應於報告前兩天(週日)繳交PPT上傳課程網站,遲交者應完成教師依據遲交或缺交情況所指定之期末報告要求)
(4) 於7月2日前繳交符合學術引註格式之學期報告,字數以8000-10000字為度。遲交報告酌予扣分。晚於7月4日繳交者,視為缺交,除非有重大不可抗力事由且經教師同意。
5. 對其他修課同學所提出之課堂報告,提出回應性的意見或建議,所提出之意見或建議,將提供給報告同學參考。每位同學應就「非自己報告」之其他兩週的課堂報告,每週選擇至少其中一份報告,提出至少一頁的回應意見,於下週一中午前繳交,遲交三日以上視為缺交。遲交或缺交者,應完成教師依據遲交或缺交情況所指定之期末報告要求。
6. 遵守學術倫理,不得抄襲或不當引用,亦不得將他門課程之報告作為本課程之報告內容。批判性閱讀心得與學期報告均應附上遵守學術倫理之聲明。
